Fill 131 form, attach a cover letter and AP - you dont need to include the fee as it is a USCIS mistake. Call USCIS 800 number or take infopass appointment before you refile.

It seems to me that USCIS are rejecting applications to establish new dates for refiling. Isn't it in their FAQ on Receipt delays that by law, they are required to issue EAD within 90 days from the applications?
I hope I am wrong but they might be doing this deliberately to get around the law.

Hi,
My H1B transfer from Company A to B is denied on 04/22/2010 and currently I am working for Company B. Company B is planning to apply for MTR. Now I am getting offer from Company C. My questions are:
1) Is it possible to get H1B transfer on premium processing approved from Company C with EOS (Extension of Status)? Do I need to apply for transfer or New H1B with Company C?
2) Can MTR affect the new H1B transfer to Company C?
Will appreciate your quick response and thanks a lot for your great help.

I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.
I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.
Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didn�t have any engagement end date there.
If you think that any appeal or ammendent can be done with USCIS, then kindly advise me accordingly. Thanks

I got really good news... EB3 moved for 1 week...... its 22nd Jan 2002 now...:rolleyes:
Based on the numbers released by USCIS on pending 485s, EB3 will go up to mid-june 2002 for the entire FY2011 (without spill over, of course)....

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Right now, employers have to go to all the trouble of preparing a case that may be rejected simply because the visa allocation is filled. I think...

Hi Guys:
I'm in a process of transfering my H1B to a new employer. I've already hired a lawyer and paid him his fee. The lawyer spoke to my employer and everything was going fine. Now, my new employer tells me that his company "froze hiring" untill further notice !?!
I'm wondering
1. Is my employer lying and why?
2. Can I somehow make my employer pay me back the money I already paid to the lawyer?

Here's my take on the new Visa Bulletin First, bad news for Dominicans. Separate cutoffs have now been established for the Family First and 2B preference categories which are now earlier than the worldwide dates. Family First is 01 JUN 2004 and 2B is 01 JAN 2002. Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

My husband has 7 words in his name on passport. When we went for Driving licence they took a part of that whole name and issued the licence. But even the last name and first are totally changed now.
How can we change his long name to short by taking only two words from 7. Does it come under Name change case or any other procedure.

After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

I am on H1-B Visa and my wife on H4. She filed for GC in Schedule A(I140&I485 filed concurrently) category. Her I140 is not approved yet. We both got our EAD cards but have not worked using our EADs. I do not intend to use my EAD to work. Our question is:
* If her I-140 gets denied will she still have her H4 status as I am still maintaining my H1?
* If not, how can she get back to H4 status? Will she be asked to leave the country immediately?
Need immediate reply.

Hi all,
I have been fortunate enough to get one step closer to a green card.
I need to fill out form 230 and Line 25 asks to list all visits to or residence in the US.
I have been living in the US for the past 7.5 years. Can I just list my residences and corresponding visas or do I have to list all visits? :confused:
I have a fair number of visits, as I have been travelling both for work and leisure in the past few years. I have most of the entry/exit stamps, but there are a few missing. So I am wondering if there will be a problem when I list the visits and some of the dates cannot be supported with passport stamps.
Can anyone please advise if listing my residence will suffice (although this is already requested in line 20)?
btw I got my notification June 4, EU00006xxx
